Clients shall indemnify, and hold harmless Propulsion Media Labs (PML), its contractors, employees, officers, and principals from all claims, loss, costs, expenses, and legal fees resulting from client negligent acts or misuse of PML’s audio and video production services including, but not limited to, script misrepresentations and unauthorized use of production aids (i.e., jingles, popular music, celebrity names/likenesses). Clients understand and agree that PML is not an advertising agency, and it is the client’s sole and exclusive responsibility for any/all script claims, offers, and incentives to comply with all truth-in-advertising rules as detailed within the Federal Trade Commission Act.
